So I have an issue with ICWA in that it provides for federally recognized tribes and children and adults who are enrolled in or eligible for membership in federally recognized tribes. There are many urban Indian people out there who are involved in their communities who cannot be considered Indian Custodians to help Indian children in terms of guardianship.
Many people agree that defining who is Indian and who isn’t is an issue. Can we have some discussion on this?
